Authorities violating court orders : Contractual teachers demand job security

Contractual teachers working in different colleges of Jammu and Kashmir on Wednesday demanded job security as the educational instituted reopened on 15 February.

Jammu and Kashmir Contractual Teachers Association (JKCTA) vice president Dr Mohammad Yousuf Nengroo told a local news agency, Kashmir News Observer (KNO) that “after seventeen months colleges were supposed to reopen from 15 February and candidates who were justifying their eligibility got status quo from JK High Court but Commissioner/Secretary Higher Education Parvez Rohella and Director Colleges are defying all the court orders pleasantly to protect their skin.”

Nengroo said that they are being biased towards Kashmir by giving the order to have classes alternatively. “All principals of Kashmir Division are harassing the candidates mentally. Candidates can earn a livelihood but they are forcing us to come on roads,” he said.


 
JKCTA President Dr. Fayaz Ahmad Wani they have written to all Deputy Commissioners of Kashmir besides Divisional Commissioner.

“We the academic arrangement faculty of different colleges of Kashmir Division in general and your district, in particular, would like to draw your kind attention towards the fact that we have been working for the smooth functioning of the system for last 2 decades. We have always worked at par with the permanent faculty of the department. We have devoted the prime of our career to the department and have always regarded our services as worship.

“Despite the fact, the department has never paid any attention to address our genuine demands/grievances. The department is hell-bent to ruin the future of this highly qualified lot as most of the candidates working in the system have crossed the upper age limit or are on the verge of becoming highly qualified overage unemployed youth of the developed democracy. Every second day the department is using all the means to mentally harass and humiliate the candidates,” reads the letter.

“Witnessing this humiliation and sensing the job insecurity about a thousand candidates working on academic arrangements moved to the honourable High Court of Jammu and Kashmir to secure their job and to their fortune honourable High Court Srinagar Wing after analyzing the petitions issued the status quo in their favour,” the letter stated.

“The department was going well with the status quo of the candidates and was maintaining their position without disturbing them and released their salaries till July 2019 and in some cases till august 2019,” it said.

“The honourable High Court from time to time issued directions to the department to release the salaries of the candidates and to the surprise the department never obeyed those orders which highlight the highhandedness of the Secretary Higher education Mr Talat Parvez Roheela and his subordinates (Director Colleges, Nodal Principal Kashmir & Principal’s of Kashmir Division Colleges),” letter reads.

The Honorable High Court also asked the department about an affidavit to confirm the stand of the department towards the court cases. In their response, the Director Colleges along with all the Principals of the Degree Colleges acknowledged the Court Case and submitted the affidavit mentioning that they have not disturbed the position of the petitioners and are maintaining their Status Quo {see Annexure A}. But in reality, they have made the contempt of the Honorable court and disturbed the position of faculty working on court orders. 

They are trying to treat us as daily rated labours and will call us at their convenience,” it further adds.

Director Collages Peerzada Mohamad Yousuf refused to comment on the issue.

Despite repeated attempts, Talat Parvez Rohella was not available for the comments.
